01In short
These terms are based on Peruvian law and are interpreted according to it. The essentials:
- You accept these terms by adding the bot, entering the panel or using its features.
- There is a free plan and a paid Premium one. Features that protect minors are never charged for.
- The image detector only works if the server owner turns it on. It doesn't keep the images.
- The server owner decides how members' data is used and has duties of their own (see "If you own a server").
02Who offers NextGen
NextGen (the Discord bot, this website and the control panel) is offered by its developer, who operates independently under the pseudonym agnonotdev and does not publish their personal identity.
- Contact: [email protected]
- Acceptance: clicking, adding the bot or signing in with Discord counts as acceptance by electronic means. If you don't agree, don't use the service.
03Who can use it
- To use NextGen, meet Discord's conditions, including its minimum age. Only the server owner, or whoever they authorize in the panel, can configure it.
- To sign up for a paid plan, you must be over 18. A minor cannot sign up for Premium on their own.
- Server members may be minors. How we protect their data is in the Privacy policy.
Legal basis: full legal capacity, article 42 of the Civil Code.
04Your responsibility when configuring
- The rules, messages and settings you save in the panel are run by the bot exactly as you decided. Set them up with care and respect Discord's rules and the law.
- You are responsible for the people you give access to the panel. You can remove their access whenever you want.
- Your session is personal. Don't share it. Whatever is done from your account in the panel is taken as done by you.
- You only get in where you belong. A server shows up in your panel if Discord gives you Manage Server or Administrator, and you can only configure it if you are the owner or the owner gave you access.
- If it is misused, we may limit or remove your access to the panel.
05If you own a server
When the bot checks members' messages or images, you, as the owner, decide what that data is used for (the data controller). NextGen acts on your behalf: it processes the data only according to your settings, keeps it confidential and secure, doesn't pass it to third parties and doesn't keep it longer than necessary.
Legal basis: articles 16 and 17 of the Personal Data Law (No. 29733) and article 31 of the Regulation of the Personal Data Law (S. D. No. 016-2024-JUS).
The law requires each person's consent and the exceptions don't cover this check. So, before turning on the image detector or the AutoMod rules you commit to:
- Inform members, in simple words, what is checked, why, that an automatic tool does it and how to ask for a review.
- Get their consent, for example through the rules or the welcome screen that they accept when joining.
- Not turn it on if your server admits children under 14 without the consent of their parents or guardians, or use it for anything other than security and moderation.
Legal basis: articles 5 and 14 of the Personal Data Law (No. 29733) and articles 6, 22 and 25 of the Regulation of the Personal Data Law.
Text you can copy into your rules:
This server uses NextGen to automatically check the images that are posted and delete those that look like scams. The image is analyzed on the spot and is not kept. If you think one was deleted by mistake, write to the moderators. By taking part in this server you accept this check.
When an AutoMod rule acts, the bot saves a numbered case for your server. Cases are the moderation records of your server: you decide what they are used for and NextGen only stores them on your behalf. Your authorized moderators can hide or delete a case with the commands or from the panel; if you remove the bot, they are deleted with the rest of your server's data 30 days later.
If a member asks us to exercise their rights over data that a server processes, we pass the request to you within 3 days and let the person know.
Legal basis: article 66 of the Regulation of the Personal Data Law.
If a security incident affects your server members' data, we tell you without delay, by Discord direct message, without waiting to have every detail (if your direct messages are closed, we won't be able to deliver it). If it is one of the incidents the law requires to be reported, notifying the Authority (within 48 hours at most) and the affected members is up to you, as the data controller.
Legal basis: articles 34 and 36 of the Regulation of the Personal Data Law (S. D. No. 016-2024-JUS).
06Scam image detector
- Off by default. It only works on servers whose owner turns it on in the panel, and it can be turned off at any time.
- What it checks: attached images (PNG, JPG, WebP and GIF, up to 8 MB, up to 4 per message) that members post in the channels the bot can see. It doesn't check other bots or anyone with the Manage Messages or Administrator permission. For animated images it checks up to 4 frames.
- How it does it: everything is automatic. The bot downloads the image from Discord and analyzes it in the memory of the machine it runs on, with four techniques: reading the text in the image, rules with typical scam phrases, a numeric fingerprint to recognize already confirmed scams and a visual comparison model (NG-3) that measures how much it looks like scam examples and like normal examples (memes, real screenshots). We don't identify the people who appear in an image and we don't use facial recognition.
- What is kept: we do not keep the image; it is discarded when the analysis ends, which takes seconds. If it is confirmed to be a scam, only its numeric fingerprint is kept, which doesn't allow rebuilding the image and doesn't include data about who sent it or the server.
- If it looks like a scam: the bot deletes the message (if it has the permission), posts a short notice that deletes itself after 15 seconds and sends an alert to the channel the owner chose, with the person's mention, the channel, the risk level, the reasons and a copy of the image. Those messages and that copy stay on Discord, under the server owner's control.
- Limits: the detector can be wrong, both by deleting a normal image and by letting a scam through. It helps, but it guarantees nothing.
07Automatic decisions and human review
The detector uses artificial intelligence and may delete a message without a person stepping in at that moment. We apply the principles of transparency, human oversight and non-discrimination.
- AutoMod: if the owner turns on AutoMod rules in the panel, the bot reads the content of new or edited messages to apply them: invites to other servers, links, spam (bursts, the same message repeated, mass mentions) and known scam patterns; the links filter can be set to let GIFs and social networks through. It does not use Discord's AutoMod tool and works with fixed rules, without artificial intelligence. If a rule matches, it can delete the message, post a notice that deletes itself, send you a direct message, silence you if the owner set that up (with Discord's timeout or with a role the owner picks), send an alert to the owner's channel with your mention, the channel and the reason, without the text of the message, and save a numbered case for the server with the text of the message (the first 1500 characters), which the owner and the server's moderators can see, hide or delete (see the Privacy Policy). With the "18+ server alert" option it also looks up invites on Discord to see whether the invited server is marked 18+. A message that triggers no rule is not stored: it is analyzed in memory and only simplified versions of each person's latest messages are kept, for up to 30 seconds and without writing them to disk, to detect bursts and repeats. It does not check other bots or anyone with the Manage Messages or Administrator permission.
- You have the right to have a person review the decision and to give your side.
- How to ask: write to [email protected] or ask the server's moderators.
Legal basis: article 7 of the Regulation of the Artificial Intelligence Law (Law No. 31814, S. D. No. 115-2025-PCM), article 23 of the Personal Data Law (No. 29733) and article 87 of the Regulation of the Personal Data Law.
08Sending images to improve the detector (NG-3)
From the panel you can send us a scam the detector didn't recognize, or a normal image it deleted by mistake. It is voluntary and is only sent by ticking the consent box on the form. You can withdraw that consent and ask us to delete what you sent at [email protected].
- Don't send personal photos of yourself or other people, images with sensitive data or illegal content. What happens if something like that arrives is in "Illegal content and reports".
- What we keep: the image, your optional note, your Discord ID, the server's, the date and the type of submission. A person on our team reviews each submission.
- For how long: if it is rejected, the image is deleted right away. If it is approved, it becomes a numeric fingerprint and the file is deleted when the bot processes it. The submission record (without the image) is deleted after 12 months.
- What they are used for: to teach the detector. Once approved, the image becomes a fingerprint added to the scam list or the allowed-image list, and that trains the detector to recognize it next time. We don't share them with third parties.
09What you write and send
What you save or send (custom messages, notes, NG-3 images) stays yours. In addition:
- Don't send passwords, tokens, payment data or other people's personal data.
- You must have the right to share what you send. If it isn't yours or you can't share it, don't send it.
- Suggestions: if you send us an idea or comment about NextGen, you give us a free, non-exclusive license to use that idea in the service, without paying or crediting you. It only covers the idea you send us; we don't take ownership of your work.
Legal basis: articles 89 and 90 of the Copyright Law (Legislative Decree No. 822): what isn't expressly assigned stays reserved to the author, and a non-exclusive license doesn't stop the author from using their work.
10Free plan and Premium
- Free and Premium: NextGen has a free plan and a paid Premium plan. Security features that protect minors are never behind a payment.
- What Premium includes: only the features shown as available on the Premium page when you sign up.
- Payments, renewal and refunds: they are governed by the Subscriptions and refunds policy, which is part of these terms.
11Acceptable use
- Don't use NextGen to harass, to spy on a server's members without their consent, to get around Discord's moderation or to commit crimes, including computer crimes. Nor for anything that breaks Peruvian law, your country's law or Discord's rules.
- Don't try to damage the service, enter another server's panel or send images to the NG-3 form to fool the detector.
Legal basis: Law No. 30096 on computer crimes and its amendments.
12Illegal content and reports
This section covers content that may be illegal. Breaking Discord's rules or these terms, by itself, does not prove that a crime was committed.
A report sent to NextGen is a notice to the service; it is not a formal police report and does not replace official reporting channels.
If we receive a report or find indications that NextGen was used to send potentially illegal contentâincluding intimate images or images of minorsâwe may limit or suspend the implicated Discord account's access to protect the service. This measure does not determine that the person committed a crime.
- When we contact authorities: when the law requires us to, or when we must report a crime, we notify the competent authorities and share relevant information we hold, in accordance with the law and our Privacy Policy.
- What information may be shared: depending on the case and what we hold, this may include the message or file received, the Discord account ID, server ID, date and source of the submission. A Discord ID identifies an account; by itself, it does not confirm who controls it.
- International cooperation: we do not automatically send every report to other countries or directly to INTERPOL. If international cooperation is needed, the competent authorities handle it through official channels. INTERPOL's National Central Bureau in Peru connects Peruvian police with other countries' National Central Bureaus; this does not mean every NextGen report is sent abroad.
13Suspension and end of service
- You can leave whenever you want by removing the bot from your server. 30 days after you remove it we delete that server's configuration (custom messages, AutoMod and its cases, scam detector, language and prefix), unless you add it back before then. If you want, you can ask us to delete it sooner at [email protected].
- If your Premium ends, its features turn off when the paid period ends and your configuration is kept.
- We may suspend the panel or remove the bot from a server only if you breach these terms, telling you the reason, except for a security emergency or an order from an authority.
14Intellectual property
- NextGen's: the name, the icon, the panel and the code belong to their creators. Don't copy, redistribute or resell them without authorization.
- Yours: what you save in the panel (for example, your custom messages) stays yours; you only authorize us to show it in your server through the bot.
- NG-3 images: they also stay yours; you only authorize us to review them and create their numeric fingerprint.
15Availability and changes
- Availability: we try to keep NextGen running at all times, but we can't guarantee it: we depend in part on Discord and other external services.
- Changes: if we change these terms or the price of a paid plan in a way that hurts you, we'll tell you at least 30 days ahead in the panel or by email, and you can cancel without penalty before it applies. We don't change the conditions of a subscription in progress without that notice.
- Third-party services: using NextGen also means following Discord's terms and Cloudflare's, which apply separately from these.
16Liability
- Free plan: it is offered as is. We don't guarantee that it runs without interruptions or that the detector is always right.
- Premium: we owe you what the Premium page offered when you signed up. We don't promise uninterrupted operation or that the detector is always right, and that doesn't reduce what we did offer or your rights.
- To the extent the law allows, we aren't liable for indirect damages, such as loss of Discord data, moderation decisions you make because of a bot notice or Discord outages we don't control.
- None of this limits liability for willful misconduct or inexcusable negligence, or your non-waivable rights as a consumer. Clauses that put onerous or disproportionate obstacles in the way of exercising your rights don't apply.
Legal basis: articles 18, 20 and 49 to 51 of the Consumer Protection and Defense Code and article 1328 of the Civil Code.
17Complaints
- First, write to us at [email protected]. We answer complaints within 15 business days at most, with no extension.
- If you're not satisfied: you can go to Indecopi (consumer matters) or, for personal data matters, to the National Authority for Personal Data Protection of the Ministry of Justice and Human Rights.
Legal basis: article 24 of the Consumer Code and articles 88 to 92 of the Regulation of the Personal Data Law.
18Cooperation with authorities
We may keep and hand over information to a competent authority when Peruvian law requires it, to report a crime and under cooperation treaties against cybercrime, such as the Budapest Convention, in force for Peru since December 1, 2019. If a security incident affects personal data, we notify the Authority and the affected people within the legal deadlines.
Legal basis: article 34 of the Regulation of the Personal Data Law.
19If a clause doesn't apply
- If part of these terms is void or can't be applied, the rest stays in force, as long as it can be separated.
- If we don't demand something at some point, we don't give up the right to demand it later. This takes away no right the law gives you as a consumer.
Legal basis: article 224 of the Civil Code (partial nullity) and articles 49 to 51 of the Consumer Protection and Defense Code.
20Governing law
These terms are governed by the laws of the Republic of Peru. Disputes that aren't resolved directly will go to the competent judges and courts of Peru, without prejudice to the non-waivable rights that the law gives to consumers.
